INFORMATION ABOUT CCV

The Online Media is owned, operated and maintained by CCV, a Company incorporated and existing under the Companies Act, 2013, having its registered office at 210A, Shahpur Jat, New Delhi- 110 049.
Through the Online Media, CCV provides information, pricing, availability and reservation of tickets, portal of dissemination of information (hereinafter referred to as “Services”) related to tradeshows, trade-fairs, conferences, workshop, meetings and exhibitions among others (hereinafter referred to as “Events”) which may be availed by You. It is clarified that CCV through the Online Media shall only act as a facilitator and shall provide Services to You who may be either interested in organizing or attending the Events as the case may be.

DISCLAIMER

The contents made available on the Online Media are provided "as is". CCV makes no warranties, express or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, CCV does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Contents on the Online Media or otherwise relating to such Contents or on any sites linked to the Online Media.
The Online Media is not an event registration service. Signup on the Online Media as an attendee does not guarantee Your entry to the event and you still might need to follow and register for the event as per the visiting guidelines laid down by the organizer of the Events. However, upon your request through the Online Media, CCV shall forward such request to the organizer for onward processing.
If You are dissatisfied with the Online Media, any Contents available thereon, or any of these Terms, CCV would like to hear from You. However, Your only legal remedy against such dissatisfaction is to stop using/ accessing the Online Media. CCV does not warrant Your use of the Online Media.

SCOPE OF SERVICES BY CCV

Subject to clause 1.2 mentioned above, CCV shall provide a platform for individuals/ companies interested in attending any of the Events organized by third party exhibitors/ organizers listed on the Online Media to connect with such exhibitors/ organizers for the purposes of availing information pertaining to such Events, making bookings/ registrations, purchasing tickets/ passes for Events and related activities. It is clarified that the role of CCV shall be solely to provide information pertaining to the Events and enable an individual to connect with the organizer w.r.t to attending Event.
Subject to clause 1.2 mentioned above, CCV shall provide a platform for individuals/ companies interested in organizing any of the Events as aforesaid to publicize/ promote such Events and enabling individuals interested in attending the Events to request access to such Events through the Online Media of CCV.
Subject to clause 2.2, any disputes arising out of non- availability of tickets/ passes or rejection of request of the individual for access to Events or any related issues shall be between the individual interested in attending the Events and the organizer of such Events and CCV claims no responsibility for the same.

SCOPE OF USE BY YOU

You agree and undertake not to sell, trade, resell or exploit for any commercial purposes, any Services (specifically any tickets/ passes made available through Online Media) provided by the CCV through. For removal of doubt, it is clarified that the Online Media is meant for personal use only and shall not be used by You for any commercial purposes in any manner whatsoever.
You further undertake not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Online Media. Limited reproduction and copying of the content of the Online Media is permitted subject to the condition that the name of CCV must be mentioned as the source for each such instance of reproduction as aforesaid. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and content of the Online Media is not permitted.

LIMITATION OF LIABILITY

In furtherance to clause 2.1 to the best of knowledge of CCV, the information/ content available on the Online Media is correct. However, CCV does not warrant, either expressly or impliedly, the information/ contents available on the Online Media and disclaims all warranties of fitness for any specific purpose or merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the information/ contents available on the Online Media.
Subject to clause 11.5 and 11.6, all reasonable efforts have been made by CCV to ensure that the information/ content available on the Online Media are correct. CCV is not the service provider and cannot ensure the correctness of the information published on the Online Media which are based on information provided by You. The information/ contents available on the Online Media could include technical, typographical, or photographic errors related to descriptions, pricing, and availability. CCV does not warrant that any of the information/ contents on the Online Media are accurate, complete, or current. CCV does not take responsibility of for any incorrect information/ content available on the Online Media as aforesaid and no liability of any loss or damage suffered by You due to any such information shall be fastened upon CCV. CCV reserves the right to correct any errors, inaccuracies or omissions and to change or update information without prior notice. In the event of any errors relating to the pricing or availability, CCV shall have the right to refuse or cancel any orders in its sole discretion. If Your credit card has been charged prior to cancellation, CCV will issue a credit to Your account in the amount of the charge.
Subject to clause 2.1 & 5.1, the Services availed from CCV Online Media are at Your own risk and CCV offers no warranty or guarantee whatsoever for the use of the Online Media. CCV makes no representations about the suitability of the information, Materials and services contained or obtained through the Online Media for any purpose, or the results that may be obtained from using the Online Media. All such information and services are provided “as is” without warranty of any kind. CCV disclaims all warranties and conditions with regard to the information and services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. CCV assumes no liability or responsibility for any omissions or errors in the information available on the Online Media. To the extent permitted by law, CCV hereby expressly excludes:
1. All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
2. Any liability for any direct, indirect, punitive, incidental, special or consequential loss or damage incurred by any user in connection with the Online Media or in connection with the use, inability to use, or results of the use of the Online Media, any websites linked to it and any Materials posted on it, including: (i) loss of income or revenue; (ii) loss of business; (iii) loss of profits or contracts; (iv) loss of anticipated savings; (v) loss of data; (vi) loss of goodwill; (vii) wasted management or office time; and whether based on tort (including negligence), strict liability, breach of contract or otherwise, even if foreseeable.
In no event shall CCV be held liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the information/contents of the Online Media, even if CCV has been notified orally or in writing of the possibility of such damage.

ACCESSING THE ONLINE MEDIA

Your use/ access of the Online Media is subject to all applicable laws, rules and regulations and You undertake that You will not use the Online Media for any purpose that is unlawful or illegal under any law for the time being in force within or outside India or prohibited by these Terms.
You are solely responsible for the substance of Your communications through the Online Media. By posting information in or otherwise using any communications service, chat room, message board, newsgroup, software library, or other interactive service that may be available to You on or through the Online Media, You agree that You will not upload, share, post, or otherwise distribute or facilitate distribution of any content (including text, communications, software, images, sounds, data, or other information) that:
1. Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or otherwise violates the Terms, rules or policies of CCV;
2. Victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
3. Infringes on any rights of patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any third party;
4. Constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
5. Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; or
6. Impersonates any person or entity, including any of CCV’s employees or representatives.
Access to the Online Media is permitted on a temporary basis and CCV reserves the right to withdraw or amend the services provided on the Online Media without prior notice. From time to time, CCV may restrict access to some parts of the Online Media, or the entire Online Media. CCV will not be liable if for any reason the Online Media is unavailable at any time or for any period. You acknowledge that the internet or CCV’s systems, services and equipment may from time to time be inoperative in full or in part as a consequence of factors including but not limited to technical breakdown, maintenance, hardware or software upgrades, any communication connectivity problems or other circumstances beyond the control of CCV. You acknowledge that CCV will not be held liable for any failure or inability to provide continuous, error free, uninterrupted Services under these or any other circumstances. Further, You also undertake not to interrupt or attempt to interrupt the operations of the Online Media, in any manner whatsoever.
In addition, the Website shall not be used in any manner, which could damage, disable, overburden or impair it or interfere with any other party's use and/or enjoyment of the Website. You shall refrain from obtaining or attempting to obtain any materials or information through any means not intentionally made available or provided for or through the Website.
Subject to clause 13 given below, the Online Media may contain links to third party websites (hereinafter referred to as “Linked Sites”) consisting of inter alia information pertaining to products and services of third parties, which may include links to maps or applications from third parties. CCV has not reviewed all of the Linked Sites to its Online Media and is not responsible for the contents of any such Linked Sites. Any outside links are provided only as a convenience. Your use/ access of Linked Sites is at Your own risk. Such Link Sites from the Online Media do not constitute CCV’s endorsement of any third party, its website, or its goods or services. CCV disclaims all liability for any damage or injury that You may experience by using/ accessing Linked Sites.

ORDERS

The acceptance and processing of any orders/ requests for the e-tickets placed by You or of Your requests for display of Your information on the Online Media (hereinafter referred to as “Bookings”) or for payment of consideration otherwise, will be at the sole discretion of CCV and You shall have no claim and shall not be entitled to raise any dispute with CCV in case of its refusal to accept any orders/ requests for Bookings or such other requests placed by You through the Online Media. CCV may carry out such checks as it deems appropriate prior to accepting any such orders/ requests, for security or other reasons and accordingly CCV reserves the right to reject any such orders/ requests.
You agree that all Bookings with respect to the Online Media are final and no requests for returns/ cancellation of the Bookings made shall be entertained by CCV. You also agree to bear all risk of loss after any Bookings, including any loss due to a computer or hard drive crash and CCV shall not be obligated to provide another copy/replacement for the documents/ receipts pertaining to the Bookings in any event whatsoever.
If You intend to make Bookings with regard to display content space for displaying information/ details of any Events being organized by You, after the Booking made by You has been accepted/ granted by CCV, it will be solely Your responsibility to provide appropriate content to be uploaded on the Online Media. The contents so provided by You, subject to the Terms shall be uploaded ‘as is’ and CCV shall not be responsible for any defects or errors that may be revealed subsequent to the publication of the content provided by You on the Online Media. Any such correction of error or defect by CCV at Your request in writing at a later stage may incur additional costs.

PRICE AND PAYMENT

Unless specified otherwise, the prices quoted on the Online Media for Bookings are the full retail prices including the applicable taxes for the concerned Bookings. CCV may update or revise the prices from time to time without prior notice to You, but such changes will not affect the concluded Bookings that have already been effected by You prior to revision of the prices by CCV.
You would be required to pay for the Bookings in the currency stated on the Online Media, using one of the payment options available on the Online Media. Processing of payments for orders placed through the Online Media is facilitated by a third party payment gateway which will handle Your payment. CCV will send You an acknowledgment and/or confirmation of the Bookings made by You. CCV shall have no responsibility or liability for any payment related dispute or claims for refund and You should directly contact the third party payment gateway and/or the bank for any issues related to payment for Bookings made through the Website. CCV does not have access to or store any information provided by You whilst making payments for any Bookings using the third party payment gateway. The collection and usage of such information will be governed by the policies of the third party payment gateway provider.
If You are unable to complete the Bookings after a successful payment is made to CCV, please contact CCV’s customer service at support@expomagik.com within 7 (seven) days of making the payment, for a resolution. If, however, the payment is not received by CCV, You would need to approach the payment gateway for enquiring the status of Your payment.

LICNECE TO USE ONLINE SPACE

Subject to Your payment of the applicable price and compliance with the Terms with respect to display of Your Content on the Online Media, CCV grants to You a worldwide non-exclusive, non-transferable personal licence to make use of such online space solely for publication of information/ details of any Events being organized by You in accordance with these Terms. You must not in any circumstances make any prohibited use of the license to use the Online Media.
Subject to clause 4.1 of the Terms provided hereinabove, the “Prohibited Use” shall mean transferring/permitting the use of or access to the online space to/by any party other than You in any manner whatsoever, whether including the above acts or not; and
If You breach any of the Terms mentioned herein, the licence will be automatically terminated upon such breach without the need for any notice of such termination.

INTELLECTUAL PROPERTY RIGHTS

Subject to Clause 11.4, CCV is the owner/licensee of all intellectual property rights including the copyright in the Content on the Online Media (including, without limitation, the text, computer code, artwork, photographs, images, music, audio material, video material and audio-visual material on the Online Media, hereinafter collectively referred to as the “Material”) or marks published on it including but not limited to logos, brand identities and other trademarks, service marks, trade names, slogans and other indicia of origin (the “Marks”). The Marks and Material are protected by copyright and trade mark laws and treaties around the world. All such rights are reserved. CCV’s status as the authors of the Material on the Online Media must always be acknowledged. For the sake of clarity, the aforesaid shall not include the Intellectual Property associated to the content provided by You to be displayed on the Online Media. Further, the Online Media may also display contents such as flags of nations, and clip arts and other indicative icons for the sake of categorization of information available therein. It is clarified that such contents being displayed therein are solely for the sake of Your ease of reference and no rights to such indicative icons are retained by CCV. Usage of icons is not in violation of any Intellectual Property Rights.
Subject to clause 4.2, You may print off one copy, and may download extracts, of any page(s) from the Online Media for Your personal reference. You must not modify the paper or digital copies of Marks/Material You have printed off or downloaded in any way, and You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. For avoidance of any doubt, You must not adapt, edit, change, transform, publish, republish, distribute, redistribute, broadcast, rebroadcast in public the Online Media or the Material on the Online Media (in any form or media) without CCV’s prior written permission.
If You wish to make any use of contents of the Online Media other than as set out above, please address Your request by email to support@expomagik.com.
If You print off, copy or download the Material/Marks or any part thereof in breach of these Terms, Your right to use the Online Media will cease immediately and You must, at CCV’s option, return or destroy any copies of the contents You have made and account to CCV for the profits earned by or accrued to You by the use of such content in addition to being liable to CCV for damages for wrongful use of Intellectual Property of CCV and breach of these Terms.
While accessing and viewing the Contents of the Online Media, You agree to comply with all copyright laws and trade mark laws existing worldwide and to prevent any unauthorized copying of any of the Material/Marks.
“EXPOMAGIK, , CONCEPT CANDY VENTURES, ” are the trademarks jointly owned by Anuj Misra s/o Tarun Misra, Sumeet Sharma s/o Sham Sunder Sharma and Nafisa Adiraju w/o Venkata Roy Adiraju, all Indian Nationals which CCV is entitled to use.

UPLOADING MATERIAL ON THE WEBSITE

Subject to Clause 6.2 stated hereinabove, whenever You make use of a feature that allows You to upload material to the Online Media, or to make contact with other users of the Online Media, You must comply with the standards acceptable to CCV. You warrant that Your actions in this regard comply with CCV standards and You agree to indemnify CCV for any breach of warranty.
By submitting to CCV any ideas, suggestions, messages, e-mails, billboard postings, drawings, opinions, images, documents and/or proposals related to alterations or improvements to the Services offered by CCV, through the “Contact Us” interface on the Online Media or otherwise (hereinafter collectively referred to as “Contributions”), You acknowledge and agree that, unless You sign a superseding agreement with CCV to the contrary: (a) Your Contributions do not contain confidential or proprietary information; (b) CCV is not under any obligation of confidentiality, express or implied, with respect to the Contributions; (c) CCV shall be entitled to use or implement such Contributions for any purpose and in any media whether now known or hereafter devised, including the creation of derivative works that may include the Contributions You provide; (d) CCV may have something similar to the Contributions already under consideration or in development; (e) Your Contributions automatically become the intellectual property of CCV without any obligation of CCV to You; and (f) You are not entitled to any accounting, payment, compensation or reimbursement of any kind for those submissions from CCV under any circumstances.
You shall not post on the Online Media any content, whether or not containing links, for any competitor of CCV. Notwithstanding anything to the contrary contained herein, You shall not use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search the Online Media other than the search engine and search agents available on the Online Media and other than generally available third party web browsers (e.g., Safari, Netscape Navigator, Microsoft Explorer).
You shall not upload files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless You own or control the rights thereto or have received all necessary consents thereto. Any material You upload to the Online Media will be considered non-confidential and non-proprietary, and CCV has the right to use, copy, edit, distribute and disclose to third parties any such material for any purpose without the payment of any compensation/fee/royalty of any kind whatsoever. You shall not delete any author attributions, notices or proprietary designations or labels in any file that is uploaded. CCV also has the right to disclose Your identity to any third party who is claiming that any material posted or uploaded by You to the Online Media constitutes a violation of its intellectual property rights, or of their right to privacy.
CCV will not be responsible, or liable to any third party, in any manner whatsoever, for the content or accuracy of any Materials posted by You or any other user of the Online Media.
CCV has the right to remove any material or posting You make on the Online Media if, in CCV’s opinion, such Content/ Material does not comply with law or the standards acceptable to CCV or may do so without assigning any reason thereof.

LINKS TO THE WEBSITE

You may link to CCV’s home page, provided You do so in a way that is fair and legal and does not damage CCV’s reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on CCV’s part where none exists.
You must not establish a link on any website leading to the Online Media, for any purposes whatsoever, without the prior written permission of CCV.
You must not create a link to any part of the Online Media other than the home page. CCV reserves the right to withdraw linking permission without notice. The website from which You are linking must comply in all respects with the existing laws and the content standards acceptable to CCV.

LINKS FROM THE WEBSITE

Subject to clause 6.5 stated hereinabove, where the Online Media contains links to other sites and resources provided by third parties, these links are provided for Your information only. CCV has no control over the contents of those sites or resources, and accepts no responsibility for such Linked Sites or for any loss or damage that may arise from Your use/ access of the Linked Sites. CCV’s inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.
Without limiting any of the disclaimers of warranty set forth in these Terms, CCV does not provide or make any representation as to the quality or nature of any of the third party information, products or services provided through the Online Media, or any other representation, warranty or guaranty. Furthermore, CCV disclaims any responsibility, if such Linked Sites (a) infringe any third party’s intellectual property rights; (b) provide any information which is inaccurate, incomplete or misleading; (c) are not merchantable or fit for a particular purpose; (d) do not undertake adequate security measures; (e) contain viruses or other items of destructive nature; or (f) provide any libellous or defamatory contents or information.

INFORMATION ABOUT YOU AND YOUR VISITS TO THE ONLINE MEDIA

If You are prompted to register to access the Online Media and You so choose to register to access the Online Media, subject to CCV’s Privacy Policy,You agree to provide CCV with accurate and complete registration information as required. W.r.t use/ access of the Online Media, You represent and confirm that You are of legal age to enter into a binding contract and You are not a person barred from using/ accessing the Online Media and/or receiving the Services under the laws of India or other applicable laws.You agree not to impersonate any person or entity or falsely state or otherwise misrepresent any information provided. You will promptly inform CCV of any changes to the registration information provided. Pursuant to registration, if You are provided with, a user identification code, name, password or any other piece of information as part of CCV’s security procedures, You must treat such information as confidential, and You must not disclose it to any third party. You are responsible for all access to, and use of the Online Media through Your user identification code, name and password including access of any services the use of which results in monetary charges, whether or not You have knowledge of, or authorise such access or use. You will notify CCV immediately of any unauthorised disclosure or use of Your user identification code, name and password. CCV has the right to disable any user identification code or password, whether chosen by You or allocated by it, at any time, if in its opinion You have failed to comply with any of the provisions of these Terms.
You certify that you are the account holder or that you have the account holder's express permission to use, the mobile phone/ email ID number provided by You to CCV.
Your registration data and other information about You collected through the use of the Online Media is subject to CCV’s Privacy Policy available on the Online Media. You acknowledge that through Your use of the Online Media, You consent to the processing and dissemination of such information to governmental authorities having jurisdiction over CCV and, if and when required, by CCV.
It is made clear that CCV will fully cooperate with any law enforcement authorities or any court order requesting or directing CCV to disclose the identity of anyone posting or transmitting any such information or material on the Online Media.

PRIVACY POLICY
CCV respects Your privacy and is committed to protecting You through compliance with this Privacy Policy enumerated under this Clause 15 which is an endeavour to demonstrate/render full compliance with the extant Indian data privacy laws, including without limitation, the Information Technology Act, 2000 and the Information Technology (Reasonable Security and Procedures and Sensitive Personal Data or Information) Rules, 2011 which govern its collection and/or disclosure of the sensitive personal data or information submitted at the time of use of the Online Media

The following Clause 15 discloses CCV’s information gathering and dissemination practices for the Online Media. The Online Media may contain links to other third party websites. CCV is not responsible for the privacy practices or the content of such other third party websites.
CCV uses Your IP address to help diagnose problems with its server and/or to administer its Online Media. This gives CCV an idea of which parts of its Online Media are being accessed by You. CCV does not link IP addresses to anything personally identifiable. This means that Your session will be tracked, but You will be anonymous.
You can visit most pages on the Online Media without giving CCV any information about yourself. However, the Online Media may at various occasions require You to give Your information like your name and contact details and other personal information.
As a general practice, no sensitive personal information or data is collected about or from You without Your consent, apart from any information or data voluntarily submitted by You. Voluntary provision of information by You shall be implied by the use of the Online Media.
Your personal information or data may be collected if You wish to create Your account on the Online Media or participate in any other membership program(s) or Events, through which You may avail services offered by CCV, receive discounts, promotions, participate in any contests, etc.
The nature of personal information or data usually received by CCV, may include the following:
1. Your account information: Your full name, email address, postal code, password and other information You may provide with Your account, such as Your gender, mobile phone number and website. Your profile picture that will be publicly displayed as part of Your account profile. You may optionally provide CCV with this information through third-party sign-in services such as Facebook and Google Plus among others. In such case, CCV may fetch and store whatever information is made available to it by You through these sign-in services;
2. Your content: Information You provide through CCV Services, including Your reviews, photographs, comments, lists, followers, the users You follow, current and prior orders/ requests for the e-tickets placed by You or Your requests for display of Your contents on the Online Media (hereinafter collectively referred to as the ‘Bookings’), contact information of people You add to, or notify of, and other information in Your account profile;
3. Your searches and other activities: The search terms You have looked up and results You selected;
4. Your browsing information: How long You used CCV’s Services and which features You used; the advertisements You clicked on;
5. Your communications: Communications between You and other users or through CCV’s Services; Your participation in a survey, poll, contest or promotion scheme; Your request for certain features (e.g., newsletters, updates or other products);
6. Your transactional information: If You make Bookings through CCV’s Services, CCV may collect and store information about You to process Your requests and automatically complete forms for future transactions, including (but not limited to) Your phone number, address, email, billing information. This information may be shared with third-parties which assist in processing and fulfilling Your requests, including third party payment gateway processors. It is however clarified that details regarding your banking accounts and debit/ credit cards shall not be stored by CCV. If You write reviews about businesses with which You conduct transactions through CCV’s Services, CCV may publicly display information that You transacted with those businesses;
7. Your Public Posts: You may also provide information (such as ratings, reviews, tips, photos, comments, likes, bookmarks, friends, lists, etc.) to be published or displayed (hereinafter collectively referred to as "Posts") on publicly accessible areas of CCV’s services, or transmitted to other users of CCV’s Services or third-parties. Your Posts are displayed on or transmitted to others at Your own risk. Although CCV limits access to certain pages, You may set certain privacy settings for such information by logging into Your account profile. Please be aware that no security measures are perfect or impenetrable. Additionally, CCV cannot control the actions of other third party users of CCV’s services with whom You may choose to share Your Posts. Therefore, CCV cannot and does not guarantee that Your Posts will not be viewed by unauthorized persons. CCV may display this information on the Services, share it with businesses, and further distribute it to a wider audience through third party sites and services. You should be careful about revealing any sensitive details about yourself in such posts.
8. Your Job Application: If Your information is submitted to CCV through its service when applying for a position with CCV, the information will be used to consider your application. CCV may retain Your information for any period of time. Further, CCV may automatically collect the following information about the computer or mobile device used by You to access the Online Media, and about Your use of the services, even if You use the services without registering or logging in:
1. CCV uses Your contact information only to respond to Your queries or send You information about CCV. Users may opt-out of receiving future mailings by choosing to request the same to CCV by return mail. CCV may use Your personal information to make the Online Media more relevant for Your needs and create and publish content that may be useful to You. CCV does not retain any personal information or data received by it longer than it is necessary for achieving the corresponding purpose, unless otherwise required under any applicable laws.
2. CCV occasionally engages third parties to provide limited services to CCV or on its behalf. To the extent permitted by law, CCV will provide those other third parties only the information they may need to deliver the service, and though they are prohibited from using that information for any other purpose, any further usage of such information by third parties will not make CCV liable.
3. CCV may disclose Your personal information if required to do so under any applicable law, or if required to be disclosed to any Government agencies who are mandated under the law to obtain such information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution and punishment of offences, or in the good-faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on CCV or the Online Media; (b) protect and defend the rights or property of CCV and its Online Media, or (c) act in urgent circumstances to protect the personal safety of CCV employees, users of CCV’s services, or members of the public at large. To the extent required under any applicable laws, Your consent will be obtained prior to disclosure of any sensitive personal data or information collected from You, such consent may be given by You by implication or specification, including in terms of Your use of the Online Media and implied awareness of the terms of this privacy statement governing such use.
4. CCV also has the right to disclose Your identity to any third party who is claiming that any material posted or uploaded by You to the Online Media constitutes a violation of its intellectual property rights, or of their right to privacy.
5. Your information may be stored and processed in India or any other country in which CCV or its affiliates, subsidiaries or agents are carrying out its operations, and by using the Online Media, You consent to any such transfer of information outside Your country.
6. When You provide Your personal information to CCV, it will not share that information with third parties without Your permission, other than for the limited exceptions already listed or if necessary for the performance of any other contract with You. It will only be used for the purposes stated above.
7. You understand that processing of payments for orders placed through the Online Media is facilitated by a third party payment gateway which will handle Your payment. CCV will send an acknowledgment and/or confirmation of the Bookings made by You. CCV shall have no responsibility or liability for any payment related dispute or claims for refund and You should directly contact the third party payment gateway and/or the bank for any issues related to payment for Bookings made through the Online Media. CCV does not have to access to or store any information provided by You whilst making payments for any Bookings using the third party payment gateway. The collection and usage of such information will be governed by the policies of the third party payment gateway provider.
8. In the event that another company acquires all or substantially all of the assets of CCV’s business through a consolidation, merger, asset purchase or other transaction, CCV, upon taking consent from You, will have the right to transfer all data (including any sensitive personal information or data) that is in its possession or under its control to such acquiring party and thereafter, the privacy policy of such acquiring party shall govern all such data and any personal information or data that is transferred to the acquiring party, and in such a case CCV will not be further responsible for the data so transferred and withheld by the acquiring party.
9. When You use/ access the Online Media, a cookie will be placed on Your machine (if You accept such cookie) or is read if You have visited the Online Media previously. One use of cookie is to assist in the collection of the Online Media visitation statistics described above.
10. Web beacons, also known as clear gif technology or action tags, may be used to assist in delivering the cookie on the Online Media. This technology tells CCV how many visitors clicked on key elements (such as links or graphics) on the Online Media. CCV does not use this technology to access Your personal information through the Online Media but is a tool used by CCV to compile aggregated statistics about the Online Media usage. CCV may share aggregated site statistics with partner companies but does not allow other companies to place clear gifs on the Online Media.
11. The Online Media uses technology from its partners for the purposes of collecting and storing these cookies, for marketing and optimization purposes. These cookies do not contain any personal or private details (such as preferences, contact details, travel trends etc.) and are virus-free. The use of the cookies also targets to deliver advertisements pertaining to Your choice and interests, and may also be placed on other websites by CCV’s advertising network partners.
12. Opting Out of Cookies: If you have any concerns about use of cookies by CCV from the Online Media, You can take action to prevent cookies being set, including changing Your browser settings to block such cookies. Advertising companies also enable You to opt-out of receiving targeted advertising, if You would prefer to do so. In the event You opt-out, You will not experience a personalized visit nor will You be able to subscribe to the service offerings on the Online Media.
13. Further, if You intend to withdraw Your consent at any time for usage of any personal information or data provided by You, CCV will respect your decision and not use such information. However, Your intention of withdrawing consent for use of Your personal information or data by CCV should be in writing, and in such a case, CCV will be under no obligation to provide or continue providing the services for which such information was provided.
This Clause 15 does not apply to any non-personal information disclosed by You or collected by CCV or any personal information or data which is in public domain or which is disclosed in pursuance of the law.
Online Media has security measures in place to protect the loss, misuse, and/or alteration of information under the control of CCV. To protect sensitive personal information or data against accidental or unlawful destruction, loss or modification and against unauthorized disclosure or access, CCV has implemented various security practices that are updated and audited on a regular basis in accordance with applicable laws. The data resides behind a firewall, with access restricted to authorized CCV personnel. Also, the servers and workstations of CCV are protected by antivirus software which are updated regularly to minimize the threats of any virus, malware or trojan attacks and are located in secure data facilities (with limited access) to further reinforce security.
Pursuant to Your registration, if You are provided with, a user identification code, name, password or any other piece of information as part of CCV’s security procedures, You must treat such information as confidential, and You must not disclose it to any third party. If CCV makes any material changes to this Privacy Policy, CCV will post the changes here though some of the provisions contained in this Privacy Policy may also be superseded by provisions or notices published elsewhere on the Online Media. VIRUSES, HACKING AND OTHER OFFENCES

Subject to clause 6.4 stated above, You must not misuse the Online Media by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Online Media, the server on which the Online Media is stored or any server, computer or database connected to the Online Media. You must not attack the Online Media via a denial-of-service attack or a distributed denial-of service attack.
CCV will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the Online Media or to Your downloading of any material posted on it, or on any website linked to it.
You are prohibited from attempting to gain unauthorized access to this Online Media or its services, other users' accounts or computer systems, through password mining or otherwise or engage in any systematic extraction of data or data fields, including without limitation e-mail addresses. The collection of e-mail addresses from the profile pages or from the database of any user for any use without the written permission of CCV and/or the user is considered as theft and legal action will be taken against offenders.
Further, You shall not sell access to or use of any services available on this Online Media.

REMINDERS AND ALERTS

You acknowledge and consent to the receipt of text messages about your registration, notifications as reminders and alerts, via SMS text message, push or email & other communication from CCV. CCV may use one or more carriers for SMS message delivery.
The reception of SMS/push messages and emails is dependent on the operation of your mobile phone/ mobile phone service provider and/or internet service provider and with which you have an account or prepaid card. CCV shall have no responsibility or liability for the damages and costs incurred by Your not receiving SMS or email/ push notifications on time or by the insufficient operation of your mobile network, mobile phone company and/or internet service provider.
You may opt out of receiving SMS, push / email notifications at any time through a written request. This can be completed via CCV website or by sending an email to support@expomagik.com which should specify the mobile no. w.r.t which the request for opting out is sought.

INDEMNIFICATION

CCV shall be indemnified, defended and held harmless by You from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to these Term, which are asserted against or incurred by CCV.

SEVERABILITY

If any section of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of these Terms would still continue in effect and such unenforceable/illegal section would be deemed severed from the remaining provisions of the Terms which shall be read as if such unenforceable/illegal provision never existed.

BREACH OF THE TERMS OF AGREEMENTS AND PRIVACY POLICY

Without prejudice to the other remedies available to CCV under these Terms or under applicable law, CCV may limit Your activity, or end Your listing, warn other users of the Your actions, immediately temporarily/indefinitely suspend or terminate Your registration, and/or refuse to provide You with access to the website if:
1. You are in breach of these Terms, and/or the documents it incorporates by reference;
2. CCV is unable to verify or authenticate any information provided by the You; or
3. CCV believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Ten Times Online.
Your suspended usage may at any time be reinstated by CCV in its sole discretion. Once your registration or listing has been suspended indefinitely you may not attempt to register with CCV or use the Online Media in any manner whatsoever. You may use Online Media again once you are reinstated. Notwithstanding the foregoing, CCV reserves the right to recover any amounts due and owed by You to CCV and/or the service provider and to take strict legal action as it may deem necessary if You breach these Terms, or the documents it incorporates by reference.

GOVERNING LAW AND JURISDICTION

The Indian courts at New Delhi, India will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Online Media although CCV retains the right to bring an action against You for breach of the Terms in Your country of residence or any other relevant country.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.

DISPUTE RESOLUTION

All disputes and differences between the Parties hereto in any way touching or concerning in general the Online Media or as regards the interpretation scope or effect of any of the Terms herein contained read with Privacy Policy shall be resolved amicably between the Parties hereto within a period of seven (7) days from the date the dispute/difference is first brought to the notice of other Party. Provided that, if the Parties are not in a position to reach an amicable solution within the aforesaid time period, then all such disputes and differences between the Parties shall be referred to Arbitration, presided over by Sole Arbitrator mutually agreed upon by the Parties and the same shall be deemed to be a reference and such Arbitration shall be governed by the provisions of the Arbitration and Conciliation Act, 1996 as amended by the Arbitration and Conciliation (Amendment) Act, 2015 and any other statutory modification or enactment thereto for the time being in force. The decision of the Sole Arbitrator shall be final and binding upon the Parties.
Any award shall be final and may be enforced in any court of competent jurisdiction. The Parties shall duly and punctually perform their obligations hereunder pending issuance of the arbitral award. The Parties shall co-operate in good faith to expedite (to the maximum extent practicable) the conduct of any arbitral proceedings commenced under this Agreement.
The remedy under Clause 18.1 is the first remedy for any dispute and no Party may commence or maintain any judicial proceeding regarding any dispute, except in accordance with Clause 18.1 above.
Each Party shall bear and pay its own costs, expenses, fees, disbursements and other charges of its counsel, in connection with the Arbitration proceedings except as may be otherwise determined by the Arbitrators.

VARIATIONS

CCV aims to update the Online Media regularly, and may change the content at any time. Any of the content on the Online Media may be out of date at any given time, and CCV is under no obligation to update such content. CCV may revise these Terms at any time by amending this page, without notice and any changes shall become a part of these Terms and shall apply immediately or at the time specified, if any. You are expected to check this page from time to time to take notice of any changes made by CCV, as they are binding on You.
By continuing to use the Online Media after such revisions/modifications, You indicate acceptance of the most recent version of Terms as amended by CCV. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on the Online Media. You may also be required to re-accept substantially revised Terms to continue using the Online Media. You can always preview the most current version of these Terms any time on the Online Media.
