  • CCV respects Your privacy and is committed to protecting You through compliance with this Privacy Policy enumerated under this Clause 15 which is an endeavour to demonstrate/render full compliance with the extant Indian data privacy laws, including without limitation, the Information Technology Act, 2000 and the Information Technology (Reasonable Security and Procedures and Sensitive Personal Data or Information) Rules, 2011 which govern its collection and/or disclosure of the sensitive personal data or information submitted at the time of use of the Online Media
    1. The following Clause 15 discloses CCV’s information gathering and dissemination practices for the Online Media. The Online Media may contain links to other third party websites. CCV is not responsible for the privacy practices or the content of such other third party websites.
    2. CCV uses Your IP address to help diagnose problems with its server and/or to administer its Online Media. This gives CCV an idea of which parts of its Online Media are being accessed by You. CCV does not link IP addresses to anything personally identifiable. This means that Your session will be tracked, but You will be anonymous.
    3. You can visit most pages on the Online Media without giving CCV any information about yourself. However, the Online Media may at various occasions require You to give Your information like your name and contact details and other personal information.
    4. As a general practice, no sensitive personal information or data is collected about or from You without Your consent, apart from any information or data voluntarily submitted by You. Voluntary provision of information by You shall be implied by the use of the Online Media.
    5. Your personal information or data may be collected if You wish to create Your account on the Online Media or participate in any other membership program(s) or Events, through which You may avail services offered by CCV, receive discounts, promotions, participate in any contests, etc.
    6. The nature of personal information or data usually received by CCV, may include the following:
      1. Your account information: Your full name, email address, postal code, password and other information You may provide with Your account, such as Your gender, mobile phone number and website. Your profile picture that will be publicly displayed as part of Your account profile. You may optionally provide CCV with this information through third-party sign-in services such as Facebook and Google Plus among others. In such case, CCV may fetch and store whatever information is made available to it by You through these sign-in services;
      2. Your content: Information You provide through CCV Services, including Your reviews, photographs, comments, lists, followers, the users You follow, current and prior orders/ requests for the e-tickets placed by You or Your requests for display of Your contents on the Online Media (hereinafter collectively referred to as the ‘Bookings’), contact information of people You add to, or notify of, and other information in Your account profile;
      3. Your searches and other activities: The search terms You have looked up and results You selected;
      4. Your browsing information: How long You used CCV’s Services and which features You used; the advertisements You clicked on;
      5. Your communications: Communications between You and other users or through CCV’s Services; Your participation in a survey, poll, contest or promotion scheme; Your request for certain features (e.g., newsletters, updates or other products);
      6. Your transactional information: If You make Bookings through CCV’s Services, CCV may collect and store information about You to process Your requests and automatically complete forms for future transactions, including (but not limited to) Your phone number, address, email, billing information. This information may be shared with third-parties which assist in processing and fulfilling Your requests, including third party payment gateway processors. It is however clarified that details regarding your banking accounts and debit/ credit cards shall not be stored by CCV. If You write reviews about businesses with which You conduct transactions through CCV’s Services, CCV may publicly display information that You transacted with those businesses;
      7. Your Public Posts: You may also provide information (such as ratings, reviews, tips, photos, comments, likes, bookmarks, friends, lists, etc.) to be published or displayed (hereinafter collectively referred to as "Posts") on publicly accessible areas of CCV’s services, or transmitted to other users of CCV’s Services or third-parties. Your Posts are displayed on or transmitted to others at Your own risk. Although CCV limits access to certain pages, You may set certain privacy settings for such information by logging into Your account profile. Please be aware that no security measures are perfect or impenetrable. Additionally, CCV cannot control the actions of other third party users of CCV’s services with whom You may choose to share Your Posts. Therefore, CCV cannot and does not guarantee that Your Posts will not be viewed by unauthorized persons. CCV may display this information on the Services, share it with businesses, and further distribute it to a wider audience through third party sites and services. You should be careful about revealing any sensitive details about yourself in such posts.
      8. Your Job Application: If Your information is submitted to CCV through its service when applying for a position with CCV, the information will be used to consider your application. CCV may retain Your information for any period of time. This information may be shared with other companies for the purpose of evaluating Your qualifications for the particular position or other available positions, as well as with third-party service providers retained by CCV to collect, maintain and analyse candidate submissions for job postings.
    7. Further, CCV may automatically collect the following information about the computer or mobile device used by You to access the Online Media, and about Your use of the services, even if You use the services without registering or logging in:
      1. CCV uses Your contact information only to respond to Your queries or send You information about CCV. Users may opt-out of receiving future mailings by choosing to request the same to CCV by return mail. CCV may use Your personal information to make the Online Media more relevant for Your needs and create and publish content that may be useful to You. CCV does not retain any personal information or data received by it longer than it is necessary for achieving the corresponding purpose, unless otherwise required under any applicable laws.
      2. CCV occasionally engages third parties to provide limited services to CCV or on its behalf. To the extent permitted by law, CCV will provide those other third parties only the information they may need to deliver the service, and though they are prohibited from using that information for any other purpose, any further usage of such information by third parties will not make CCV liable.
      3. CCV may disclose Your personal information if required to do so under any applicable law, or if required to be disclosed to any Government agencies who are mandated under the law to obtain such information for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution and punishment of offences, or in the good-faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on CCV or the Online Media; (b) protect and defend the rights or property of CCV and its Online Media, or (c) act in urgent circumstances to protect the personal safety of CCV employees, users of CCV’s services, or members of the public at large. To the extent required under any applicable laws, Your consent will be obtained prior to disclosure of any sensitive personal data or information collected from You, such consent may be given by You by implication or specification, including in terms of Your use of the Online Media and implied awareness of the terms of this privacy statement governing such use.
      4. CCV also has the right to disclose Your identity to any third party who is claiming that any material posted or uploaded by You to the Online Media constitutes a violation of its intellectual property rights, or of their right to privacy.
      5. Your information may be stored and processed in India or any other country in which CCV or its affiliates, subsidiaries or agents are carrying out its operations, and by using the Online Media, You consent to any such transfer of information outside Your country.
      6. When You provide Your personal information to CCV, it will not share that information with third parties without Your permission, other than for the limited exceptions already listed or if necessary for the performance of any other contract with You. It will only be used for the purposes stated above.
      7. You understand that processing of payments for orders placed through the Online Media is facilitated by a third party payment gateway which will handle Your payment. CCV will send an acknowledgment and/or confirmation of the Bookings made by You. CCV shall have no responsibility or liability for any payment related dispute or claims for refund and You should directly contact the third party payment gateway and/or the bank for any issues related to payment for Bookings made through the Online Media. CCV does not have to access to or store any information provided by You whilst making payments for any Bookings using the third party payment gateway. The collection and usage of such information will be governed by the policies of the third party payment gateway provider.
      8. In the event that another company acquires all or substantially all of the assets of CCV’s business through a consolidation, merger, asset purchase or other transaction, CCV, upon taking consent from You, will have the right to transfer all data (including any sensitive personal information or data) that is in its possession or under its control to such acquiring party and thereafter, the privacy policy of such acquiring party shall govern all such data and any personal information or data that is transferred to the acquiring party, and in such a case CCV will not be further responsible for the data so transferred and withheld by the acquiring party.
      9. When You use/ access the Online Media, a cookie will be placed on Your machine (if You accept such cookie) or is read if You have visited the Online Media previously. One use of cookie is to assist in the collection of the Online Media visitation statistics described above.
      10. Web beacons, also known as clear gif technology or action tags, may be used to assist in delivering the cookie on the Online Media. This technology tells CCV how many visitors clicked on key elements (such as links or graphics) on the Online Media. CCV does not use this technology to access Your personal information through the Online Media but is a tool used by CCV to compile aggregated statistics about the Online Media usage. CCV may share aggregated site statistics with partner companies but does not allow other companies to place clear gifs on the Online Media.
      11. The Online Media uses technology from its partners for the purposes of collecting and storing these cookies, for marketing and optimization purposes. These cookies do not contain any personal or private details (such as preferences, contact details, travel trends etc.) and are virus-free. The use of the cookies also targets to deliver advertisements pertaining to Your choice and interests, and may also be placed on other websites by CCV’s advertising network partners.
      12. Opting Out of Cookies: If you have any concerns about use of cookies by CCV from the Online Media, You can take action to prevent cookies being set, including changing Your browser settings to block such cookies. Advertising companies also enable You to opt-out of receiving targeted advertising, if You would prefer to do so. In the event You opt-out, You will not experience a personalized visit nor will You be able to subscribe to the service offerings on the Online Media.
      13. Further, if You intend to withdraw Your consent at any time for usage of any personal information or data provided by You, CCV will respect your decision and not use such information. However, Your intention of withdrawing consent for use of Your personal information or data by CCV should be in writing, and in such a case, CCV will be under no obligation to provide or continue providing the services for which such information was provided.
    8. This Clause 15 does not apply to any non-personal information disclosed by You or collected by CCV or any personal information or data which is in public domain or which is disclosed in pursuance of the law.
    9. Online Media has security measures in place to protect the loss, misuse, and/or alteration of information under the control of CCV. To protect sensitive personal information or data against accidental or unlawful destruction, loss or modification and against unauthorized disclosure or access, CCV has implemented various security practices that are updated and audited on a regular basis in accordance with applicable laws. The data resides behind a firewall, with access restricted to authorized CCV personnel. Also, the servers and workstations of CCV are protected by antivirus software which are updated regularly to minimize the threats of any virus, malware or trojan attacks and are located in secure data facilities (with limited access) to further reinforce security.
    10. Pursuant to Your registration, if You are provided with, a user identification code, name, password or any other piece of information as part of CCV’s security procedures, You must treat such information as confidential, and You must not disclose it to any third party. You are responsible for all access to, and use of the Online Media through Your user identification code, name and password including access of any services the use of which results in monetary charges, whether or not You have knowledge of, or authorise such access or use. You will notify CCV immediately of any unauthorised disclosure or use of Your user identification code, name and password. CCV has the right to disable any user identification code or password, whether chosen by You or allocated by it, at any time, if in its opinion You have failed to comply with any of the provisions of these Terms.
    11. Pursuant to Your registration, if You are provided with, a user identification code, name, password or any other piece of information as part of CCV’s security procedures, You must treat such information as confidential, and You must not disclose it to any third party. You are responsible for all access to, and use of the Online Media through Your user identification code, name and password including access of any services the use of which results in monetary charges, whether or not You have knowledge of, or authorise such access or use. CCV has the right to disable any user identification code or password, whether chosen by You or allocated by it, at any time, if in its opinion You have failed to comply with any of the provisions of these Terms.

CCV reserves the right to amend this Privacy Policy enumerated under this Clause 15 from time to time to reflect changes in the law, CCV’s data collection and use practices, the features of CCV’s services, or advances in technology. Please check this page periodically for changes. Use of information collected by CCV is subject to the Privacy Policy in effect at the time such information is used. If CCV makes any material changes to this Privacy Policy, CCV will post the changes here though some of the provisions contained in this Privacy Policy may also be superseded by provisions or notices published elsewhere on the Online Media. Please review the changes posted on Online Media carefully. Your continued use of the services following the posting of changes to this Privacy Policy will constitute Your consent and acceptance of those changes.

  • VIRUSES, HACKING AND OTHER OFFENCES
    1. Subject to clause 6.4 stated above, You must not misuse the Online Media by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Online Media, the server on which the Online Media is stored or any server, computer or database connected to the Online Media. You must not attack the Online Media via a denial-of-service attack or a distributed denial-of service attack.
    2. CCV will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of the Online Media or to Your downloading of any material posted on it, or on any website linked to it.
    3. You are prohibited from attempting to gain unauthorized access to this Online Media or its services, other users' accounts or computer systems, through password mining or otherwise or engage in any systematic extraction of data or data fields, including without limitation e-mail addresses. The collection of e-mail addresses from the profile pages or from the database of any user for any use without the written permission of CCV and/or the user is considered as theft and legal action will be taken against offenders.
    4. Further, You shall not sell access to or use of any services available on this Online Media.
  • REMINDERS AND ALERTS
    1. You acknowledge and consent to the receipt of text messages about your registration, notifications as reminders and alerts, via SMS text message, push or email & other communication from CCV. CCV may use one or more carriers for SMS message delivery.
    2. The reception of SMS/push messages and emails is dependent on the operation of your mobile phone/ mobile phone service provider and/or internet service provider and with which you have an account or prepaid card. CCV shall have no responsibility or liability for the damages and costs incurred by Your not receiving SMS or email/ push notifications on time or by the insufficient operation of your mobile network, mobile phone company and/or internet service provider.
    3. You may opt out of receiving SMS, push / email notifications at any time through a written request. This can be completed via CCV website or by sending an email to support@expomagik.com which should specify the mobile no. w.r.t which the request for opting out is sought.
  • INDEMNIFICATION
    1. CCV shall be indemnified, defended and held harmless by You from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You pursuant to these Term, which are asserted against or incurred by CCV.
  • SEVERABILITY
    1. If any section of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of these Terms would still continue in effect and such unenforceable/illegal section would be deemed severed from the remaining provisions of the Terms which shall be read as if such unenforceable/illegal provision never existed.
  • BREACH OF THE TERMS OF AGREEMENTS AND PRIVACY POLICY
    1. Without prejudice to the other remedies available to CCV under these Terms or under applicable law, CCV may limit Your activity, or end Your listing, warn other users of the Your actions, immediately temporarily/indefinitely suspend or terminate Your registration, and/or refuse to provide You with access to the website if:
      1. You are in breach of these Terms, and/or the documents it incorporates by reference;
      2. CCV is unable to verify or authenticate any information provided by the You; or
      3. CCV believes that the user's actions may infringe on any third party rights or breach any applicable law or otherwise result in any liability for the user, other users of the website and/or Ten Times Online.
    2. Your suspended usage may at any time be reinstated by CCV in its sole discretion. Once your registration or listing has been suspended indefinitely you may not attempt to register with CCV or use the Online Media in any manner whatsoever. You may use Online Media again once you are reinstated. Notwithstanding the foregoing, CCV reserves the right to recover any amounts due and owed by You to CCV and/or the service provider and to take strict legal action as it may deem necessary if You breach these Terms, or the documents it incorporates by reference.
  • GOVERNING LAW AND JURISDICTION
    1. The Indian courts at New Delhi, India will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Online Media although CCV retains the right to bring an action against You for breach of the Terms in Your country of residence or any other relevant country.
    2. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.
  • DISPUTE RESOLUTION
    1. All disputes and differences between the Parties hereto in any way touching or concerning in general the Online Media or as regards the interpretation scope or effect of any of the Terms herein contained read with Privacy Policy shall be resolved amicably between the Parties hereto within a period of seven (7) days from the date the dispute/difference is first brought to the notice of other Party. Provided that, if the Parties are not in a position to reach an amicable solution within the aforesaid time period, then all such disputes and differences between the Parties shall be referred to Arbitration, presided over by Sole Arbitrator mutually agreed upon by the Parties and the same shall be deemed to be a reference and such Arbitration shall be governed by the provisions of the Arbitration and Conciliation Act, 1996 as amended by the Arbitration and Conciliation (Amendment) Act, 2015 and any other statutory modification or enactment thereto for the time being in force. The decision of the Sole Arbitrator shall be final and binding upon the Parties.
    2. Any award shall be final and may be enforced in any court of competent jurisdiction. The Parties shall duly and punctually perform their obligations hereunder pending issuance of the arbitral award. The Parties shall co-operate in good faith to expedite (to the maximum extent practicable) the conduct of any arbitral proceedings commenced under this Agreement.
    3. The remedy under Clause 18.1 is the first remedy for any dispute and no Party may commence or maintain any judicial proceeding regarding any dispute, except in accordance with Clause 18.1 above.
    4. Each Party shall bear and pay its own costs, expenses, fees, disbursements and other charges of its counsel, in connection with the Arbitration proceedings except as may be otherwise determined by the Arbitrators.
  • VARIATIONS
    1. CCV aims to update the Online Media regularly, and may change the content at any time. Any of the content on the Online Media may be out of date at any given time, and CCV is under no obligation to update such content. CCV may revise these Terms at any time by amending this page, without notice and any changes shall become a part of these Terms and shall apply immediately or at the time specified, if any. You are expected to check this page from time to time to take notice of any changes made by CCV, as they are binding on You.
    2. By continuing to use the Online Media after such revisions/modifications, You indicate acceptance of the most recent version of Terms as amended by CCV. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on the Online Media. You may also be required to re-accept substantially revised Terms to continue using the Online Media. You can always preview the most current version of these Terms any time on the Online Media.
